Terms of Service

1. Acceptance of Terms
By downloading, installing, accessing, or using the Works Mania mobile application or website (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Works Mania.
If you do not agree to these Terms, you must not access or use the Platform.
2. Eligibility
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that:
- You are at least 18 years old.
- You have the legal capacity to enter into these Terms.
- You are not prohibited from using the Platform under any applicable law.
- If you are using the Platform on behalf of an organisation, you have authority to bind that organisation to these Terms.
3. User Accounts
To access most features of the Platform, you must create an account. You agree to:
- Provide accurate, complete, and up-to-date registration information.
- Maintain the security of your account credentials and not share your password with others.
- Promptly notify us of any unauthorised use of your account.
- Accept responsibility for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or engage in fraudulent activity.
5. Bookings & Scheduling
5.1 Booking a Service
When you book a service through the Platform, you are entering into a direct agreement with the assigned Professional for the provision of that service. Works Mania is not a party to this agreement.
5.2 Cancellations
You may cancel a booking before the Professional has commenced travel to your location, subject to any applicable cancellation fees. Cancellation within 30 minutes of the scheduled service start time may attract a cancellation fee.
5.3 No-Shows
If a Customer is not reachable or present at the service location at the agreed time without prior cancellation, Works Mania reserves the right to charge a no-show fee.
6. Payments & Refunds
6.1 Pricing
Service prices are displayed on the Platform at the time of booking. Prices are inclusive of applicable taxes unless stated otherwise. Works Mania reserves the right to update pricing at any time.
6.2 Payment Processing
Payments are processed through secure third-party payment gateways. By making a payment, you authorise us to charge the applicable amount to your selected payment method.
6.3 Refunds
Refunds may be issued at Works Mania's discretion in the following cases:
- A Professional fails to show up without prior notice.
- The service delivered is materially different from what was agreed.
- A verifiable technical error resulted in a duplicate charge.
Refund requests must be submitted within 48 hours of the service completion date by contacting support@worksmania.com.
7. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable regulation.
- Harass, abuse, threaten, or harm any Professional, Customer, or Works Mania staff.
- Post false, misleading, or defamatory reviews or content.
- Attempt to contact or transact with Professionals outside the Platform to circumvent our fees.
- Scrape, reverse-engineer, or exploit any part of the Platform.
- Upload or transmit viruses, malware, or any other malicious code.
- Impersonate any person or entity or falsely represent your affiliation with any person.
Violation of these conduct rules may result in immediate account suspension or termination.
8. Service Professionals
Service Professionals who join the Platform agree to additional terms outlined in the Professional Partner Agreement. Key obligations include:
- Providing services in a professional, timely, and workmanlike manner.
- Maintaining all required licences, certifications, and insurance.
- Complying with all applicable health, safety, and labour laws.
- Not discriminating against Customers on any prohibited basis.
Works Mania conducts background verification on Professionals but does not guarantee the accuracy or completeness of any verification. Customers are encouraged to review Professional profiles and ratings before booking.
9. User Content
By submitting reviews, photos, or other content ("User Content") to the Platform, you grant Works Mania a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and distribute that content in connection with the Platform.
You represent that you own or have the necessary rights to submit User Content and that it does not violate the rights of any third party or any applicable law.
We reserve the right to remove any User Content that violates these Terms or that we determine is harmful, offensive, or inappropriate.
10. Intellectual Property
All content, design, logos, trademarks, software, and other materials on the Platform are the exclusive property of Works Mania or its licensors and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our express written permission.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- Works Mania is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any services booked through it.
- Works Mania's total liability to you for any claim shall not exceed the total amount paid by you through the Platform in the 12 months preceding the claim.
- Works Mania is not responsible for any damage to property, personal injury, or loss caused by a Professional during service delivery.
Some jurisdictions do not allow the limitation of certain warranties or liability. In such cases, some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Works Mania and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your access to or use of the Platform.
- Your violation of these Terms.
- Your User Content.
- Your violation of any third-party rights.
13. Termination
Works Mania may suspend or terminate your access to the Platform at any time, with or without notice, for any reason including breach of these Terms.
You may delete your account at any time through the app settings. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, via email or in-app notification. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
15. Governing Law & Disputes
These Terms are governed by and construed in accordance with the applicable laws of the jurisdiction in which Works Mania is registered, without regard to conflict of law principles.
Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.
